You are hereby notified that after careful consideration of your application
dated  March 15, 2000 and after a Public Hearing as required by Chapter 40A, M.G.L., the Appeal Board voted:

(    )   To deny the application.

(xx)   To approve the application and    VARIANCE
         is hereby approved subject to conditions hereto annexed.

REPRESENTATIONS TO BOARD:
                
                1.  The applicant requested a variance to allow construction of a                       two-story home with garage on a 4,580 sq.ft lot which is a
                non-conforming lot.                             
                
                2.  Applicant requested permission to use footage from paper street
                to add to the lot size to make it conform to current zoning  by-laws.   
                
                3.  Paper street known as Leon Court is not noted on Mr. Slade’s deed.                          
                
                4.  The size of the house to be constructed is 25 ft. x 28 ft.
                                
                
                5.  The property has been in the family since 1945  and has been
                a vacant lot.                           .
                
                
                
                
                
                
                                        
FINDINGS:               
                        
        1.  With regard to the requested Variance, the Board finds;

                a.  A literal enforcementof the provisions of this By-Law would involve a                    substantial financial hardship to the petitioner or applicant, as set forth                     in the testimony.

                b.  The hardship is owing to circumstances relating to the soil conditions,             shape, or topography of the land and especially affecting such land but
                not affecting generally the zoning district.              .
                c.  The desired relief does not create a substantial detriment to the public            good.

                d.  The desired relief does not nullify or substantially derogate from the
                intent or purpose of the By-Law.

DECISION:

        The Application for a Variance is granted, subject to the following conditions:

                1.  Applicant shall obtain all necessary permits from all other Boards in the                Town of Hanson;

                2.  The project shall be constructed in conformity with the plan filed with                  this Board with the petition; prepared for the applicants by Land               Planning , Inc. Engineering & Survey, Bernard Munro, Representative.

                3.  This decision must be recorded with the Plymouth Registry of Deeds               within one year from the filing of this decision with the Clerk of the                  Town of Hanson.


ANY PERSON AGGRIEVED BY THIS DECISION MAY APPEAL TO THE SUPERIOR COURT DEPARMENT FOR PLYMOUTH COUNTY, BY BRINGING ACTION WITHIN TWENTY (20) DAYS AFTER DECISION HAS BEEN FIELD IN THE OFFICE OF THE TOWN CLERK.
